Terms of Service

Welcome to Neighbourly. These Terms of Service ("Terms") govern your access to and use of the Neighbourly API, website, and related services ("Services"). By using Neighbourly, you agree to these Terms.
1. Use of Services
- You must be at least 18 years old and legally capable of entering into agreements.
- You may use the API only in accordance with applicable laws and these Terms.
- You are responsible for maintaining the confidentiality of your API key and any account credentials.
- You must not reverse engineer, resell, or misuse the Service in a way that disrupts performance or violates applicable laws.
2. Account Registration
- To access the API, you must register and provide accurate contact information. We reserve the right to suspend or terminate accounts that provide false or incomplete information.
3. API Usage and Limits
- Each plan includes a defined number of monthly API requests as specified on the Pricing page.
- Exceeding these limits may result in additional charges or temporary rate-limiting.
- You agree not to use automated tools to circumvent request quotas or authentication mechanisms.
4. Payment and Billing
- Paid plans are billed monthly or annually in Canadian dollars.
- All fees are non-refundable once access is granted.
- Late or failed payments may result in temporary suspension of service.
5. Intellectual Property
- Neighbourly, including all APIs, documentation, datasets, and branding, remains the sole property of Neighbourly Inc.
- You retain ownership of any applications you build that use the API, but not of the API itself or its underlying data models.
6. Acceptable Use
You agree not to:
- Use the API to violate privacy laws, scrape personal data, or build competitive datasets without consent.
- Attempt unauthorized access or interfere with Neighbourly systems.
- Misrepresent Neighbourly's data as your own proprietary source without attribution.
Neighbourly may suspend or terminate access for violations.
7. Availability and Maintenance
- We strive for high availability but do not guarantee uninterrupted service.
- Planned maintenance or outages will be communicated in advance where possible.
8. Disclaimer of Warranties
- The Services are provided "as is" without warranties of any kind, express or implied.
- Neighbourly does not warrant that the data will be error-free or suitable for every purpose.
9. Limitation of Liability
- To the maximum extent permitted by law, Neighbourly shall not be liable for any indirect, incidental, or consequential damages arising from use of the Services.
- Total liability for any claim shall not exceed the amount paid for the Services in the preceding 3 months.
10. Termination
- You may stop using the Service at any time.
- Neighbourly may suspend or terminate your account if you violate these Terms or use the API in a harmful or unlawful manner.
11. Changes to Terms
- We may update these Terms periodically. Continued use of the Service after an update constitutes acceptance of the new Terms.
12. Governing Law
- These Terms are governed by the laws of Ontario and the federal laws of Canada.
- Any disputes shall be resolved in the courts of Ottawa, Ontario.
